Fair use is a copyright principle that allows limited use of copyrighted material for the purposes of teaching, research, criticism, commentary, or scholarship.
There are four factors that must be considered when analyzing whether the use of a copyrighted work is permissible under the Fair Use Doctrine.
All of the factors must be considered together:
- The purpose and character of the use
- The nature of the copyrighted work being used.
- The amount or substantiality of the portion of the work being used.
- The effect of the use on the market for, or value of, the work.
